Terms & Conditions
Important Notice:
Every effort has been made to ensure the accuracy of the information given in the prospectus and other literature issued by Havering Adult College (the College). Please note that this website and our prospectus is merely a guide to our intended course provision and the College cannot guarantee its provision in the event of circumstances beyond its control. In such an event, the College will endeavour to provide an alternative where possible. However, we reserve the right to cancel, combine or re-schedule courses and to make changes to the content, teaching and assessment provided on any course and to any facilities offered. The College will not be liable to any user of its services or facilities for any indirect or consequential loss which may be suffered by you as a result of any breach by the College of any obligations to the user or any other act or omission of the College or its employees.
Data Protection
The information you provide on the enrolment form will be passed to the Education and Skills Funding Agency (ESFA) and Greater London Authority (GLA), which are compliant with data protection legislation. Your data is used to meet their statutory responsibilities and to maintain a unique learner number and personal learner record.
The ESFA/GLA may share this information with third parties for education, training, employment and well-being purposes, including research. Further information about data confidentiality is available upon request or from the GLA and ESFA websites.
Variation or Cancellation of Courses
The contents of the courses are believed to be correct and to reflect the current state of knowledge at the point of publication. The College reserves the right to make alterations to courses, teachers, fees or venues without prior notice provided such alterations shall not substantially affect the course content or qualification. Such alterations shall, at best, only entitle the participant to reimbursement of course fees paid if such adjustments substantially differ from the advertised programme.
The College reserves the right to cancel or reschedule courses at their discretion if in the opinion of the College there are insufficient enrolments or attendees to make the course financially viable. In such cases the participant shall be offered a transfer to an alternative course. The College commits to notifying learners if their course has insufficient numbers to go ahead at least five days before the start of the course.
If not appropriate/acceptable a credit note for course fees will be issued. In such cases the College’s liability shall be restricted to a reimbursement of any fees paid to the College. In the event of the cancellation of courses or classes for a reason outside the control of the College, the College shall be under no obligation to provide any reimbursement. However, in the event of a prolonged closure, outside of the college’s control, we may review this policy in light of the specific cause.
Attendance
Certification Process
On completing your accredited course, your work goes through our quality assurance process. This includes the assessor and a trained internal quality assurer marking and reviewing your work. A sample is then sent to an external quality assurer, who works with the relevant awarding body. When they confirm they agree with the marking, we can then request certificates for those who achieve.
The time this process takes varies dependent on the course, and the awarding body. In some cases we may need to wait for an appointment with the external quality assurer and this can delay when a certificate can be requested. It is therefore difficult for the team to tell you exactly when your certificate will be available.
You will be informed via email when your certificate and/or portfolio are ready for collection. Where possible, portfolios will be returned alongside your certificate. For many of our courses, an e-certificate will replace hard copy certificates and this will be emailed directly to you.
In line with awarding body guidelines, any hardcopy documents are stored for a minimum of one year following the issue of your certificate, and then portfolios may be destroyed and certificates returned to the awarding body if not collected.
Copyright
Liability and Insurance
The College shall not be liable for any loss or damage suffered by a learner in connection with the provision of any course or service except in the case of personal injury, loss suffered as a direct result of the College’s negligence or death. The College shall not be liable to the learner for any delay in performing, or any failure to perform, any of the College’s obligations, if the delay or failure was due to any cause beyond the College’s reasonable control.
The College does not insure learners’ personal belongings and as such, learners are responsible for making appropriate provision in respect of insurance arrangements to protect their property (including vehicles) and person. This includes learners opting to park of their own volition at any of the College’s sites. Learners accept by signing the enrolment form that they attend and park at their own risk.
The College will not store learners’ completed work for longer than 12 months after the completion of a course. The College will attempt to contact learners to remind them to collect their work. After this time, the College will take steps to dispose of portfolios not claimed by learners.
Contract
Internal Progression
The College will provide existing learners with the opportunity to progress vertically to the next level of course (or laterally to an alternative or associated interest course, providing a Pre-Course Interview (PCI) appointment is not required). The teacher will determine if learners qualify for the automatic right of progression assuming all entry requirements are met. This will take place prior to general release of the prospectus to the public. Please note, re-enrolling on the same course at the same level is not an option under these terms.
Interest List
The College will compile a list of those prospective learners who express an interest in our upcoming courses. Prior to the launch of the new prospectus, those on the list will be contacted by email to confirm that enrolment is now open. Please note as courses (and appointments for a PCI) are filled on a first come, first served basis to allow for equality of access, we cannot hold places, nor can we guarantee priority enrolment to those on an interest list. The College does not maintain waiting lists for courses. On occasion, the College may take prospective learner details linked to courses we presently do not offer to support curriculum planning, but it cannot be guaranteed that courses requested can always be offered.
NOTE: Nothing in these Terms and Conditions of Enrolment affects your statutory rights.
Financial Terms & Conditions
Payment Terms
Settlement is due on enrolment. Places will not be held without payment. Settlement in full or in part by agreement with the College will ensure that your name appears on the course register.
Interest
The College reserves the right to charge interest at the current Bank of England base rate plus 2% per month if payment is not made by the due date.
Withdrawal from Course
All fees agreed on enrolment will be due regardless of whether a student later withdraws from the course. This includes where fees are being covered by Advanced Learner Loans, as the loans will terminate at the point of withdrawal and the learner will assume full liability for all outstanding fees to the College, as well as repayments to the loan’s provider. Similarly, where payment is by instalments, at the point of withdrawal the outstanding fees will become due in full and final settlement. Those in receipt of full fee remission due to their status will also become liable for the amount of fees due for the remainder of the course, as funding associated with that enrolment will cease at the point of withdrawal and could otherwise adversely affect the financial viability of any given course. The London Borough of Havering will seek to recover any monies owed, and non- payment could result in a County Court Judgement (CCJ). A CCJ can affect your credit rating for up to six years.
Reimbursement
Once enrolled, a learner is liable for the fee identified in this agreement regardless of whether they subsequently decide to withdraw from the course. Reimbursement in whole or in part for fees paid will only be considered in truly exceptional cases. All applications for reimbursement must be made in writing. Appropriate supporting documentation must be attached (e.g. medical certificates). Please note, once a course has been purchased, there is no automatic entitlement to a refund. The College reserves the right to make a deduction of £25 from such reimbursements to represent the administration and other costs to the College occasioned by the learner’s withdrawal. If the College requires a learner to leave for reasons of conduct, the learner will remain liable for the full amount agreed at enrolment.
Credit Notes
If agreed between the learner and the College, a credit note may be issued following a withdrawal. Credit notes may be valid for a one-year period from the date of issue and are non-transferable to another learner.
Fee Reductions
Fee reductions will only be applicable to courses as indicated in the prospectus and to learners meeting the criteria as laid down in the prospectus. Evidence must be provided. Evidence may be further checked to ensure all learners are still eligible for any concession applied at the commencement of the course.
Receipts
Receipts will be provided for all monies paid to the College except where payment is made through BACS or standing order.
Certificates and Results
Non-Acceptance of Enrolment
The College reserves the right not to accept applicants or enrolments from individuals or sponsors where fees or other costs from previous courses remain outstanding until such time as all outstanding fees or other outstanding costs are paid.
Non-Payment of Fees
In addition to the terms above, the College reserves the right to terminate an enrolment at any time during the life of a course where fees are outstanding or where any agreed instalment payment defaults.
The College may take legal action for the recovery of monies due and in such circumstances the College reserves the right to make charges of up to £300 to represent the administration and other costs to the College occasioned by the non-payment.
